1. DEFINITIONS
- Sector 6 Photography (Carl Silver): We, us, Sector 6 or S6.
- Customer or Client: Your and You.
- Consumer or Client: Any person who buys goods from us for purposes which are outside his trade, business or profession.
- Goods: Any products or services sold by us to you including photographs, CD/DVD image collections, photo prints, canvas prints or editing services

2. SERVICE AVAILABILITY
- Our photography services are only intended for use by people resident in the United Kingdom. Our online store accepts international orders for digital download products and orders from the United Kingdom and European Union for physical prints/products.
3. YOUR STATUS
- By placing an order through our site, you warrant that:
(a) You are legally capable of entering into binding contracts; and
(b) You are at least 18 years old;
(c) You are resident in one of the Serviced Countries; and
(d) You are accessing our site from that country.
4. PRICE AND PAYMENT
- 4.1 The price of any Products will be as quoted on our site from time to time, except in cases of obvious error.
- 4.2 These prices exclude delivery costs, which will be added to the total amount due. You will be given delivery options prior to confirming your order.
- 4.3 We are under no obligation to provide the Product to you at the incorrect (lower) price, even after we have sent you a Dispatch Confirmation, if the pricing error is obvious and unmistakable and could have reasonably been recognized by you as a miss-pricing.
- 4.4 Payment for all Products must be by PayPal or via credit/debit card (via PayPal)
5. COPYRIGHT
- 5.1 The entire copyright in the pictures is retained by Sector 6 Photography (Carl Silver) at all times throughout the world.
- 5.2 Sector 6 Photography supplies the technical and artistic ability to illustrate an idea photographically, and sells the right to reproduce those pictures in a given context. No property or copyright in any pictures shall pass to the Client whether on its submission or on Sector 6s' grant of reproduction rights in respect thereof.
- 5.3 Sector 6 Photography (Carl Silver) asserts both his moral right to be identified as the author of his work and the right to a credit is asserted in accordance with sections 77 and 78 of Copyright, Designs and Patents Act 1988.
- 5.4 Unless otherwise agreed in writing if any picture reproduced by the Client omits the copyright notice or credit line specified by Sector 6 Photography any fee payable by the Client shall be subject to an increase specified by Sector 6 Photography, and in any event an increase of not less than 25%
6. REPRODUCTION RIGHTS
- 6.1 Reproduction rights (if and when granted) are strictly limited to the use and period of time specified by Sector 6 Photography. An agreement must be reached with Sector 6 before the pictures are used for a different purpose or after the licence to use has expired.
- 6.2 Reproduction rights are not issued exclusively to the Client except when specified.
- 6.3 Reproduction rights granted are personal to the Client and may not be assigned, nor may any picture submitted to the Client be loaned or transferred to third parties save for the purpose of the exercise by the Client of such reproduction rights
- 6.4 Any reproduction rights granted are by way of licence and no partial or other assignment of copyright shall be implied
- 6.5 Sector 6 reserves the right to refuse to supply or grant a reproduction licence to a third party when requested to do so by the Client.

7. REPRODUCTION TERMS
The following terms are used when describing the reproduction rights granted by Sector 6 Photography to the Client:
- (a) Personal Use only: The right to use the pictures only within a company/household for non-profit purposes
- (b) PR and Press distribution: The right to use the pictures as described in 7(a); plus a licence for third parties to reproduce such pictures in print or electronic media in an editorial context where no fee has been paid to guarantee publication
- (c) Specified Use Only: The right to use the pictures once only for the purpose as described
- (d) Editorial: One reproduction only of pictures supplied within one print edition of the specified title in an editorial context only.
- In the case of printed publications, three copies of the relevant page(s) containing any picture(s) supplied are to be furnished to Sector 6 free of charge within two weeks. In other media, evidence of use must be made available if requested.
8. BOOKINGS
- 8.1 Once the Client has made a booking for a specific time and date, Sector 6 will not accept any other work from other clients for those times and dates.
- 8.2 As a result, once a booking is made, if it is subsequently cancelled the Client will be liable for the following cancellation and postponement charges;
- Less than 48 hours in advance 100% of the service order value
- 5 days to 48 hours in advance 50% of the service order value
- 10 days to 6 days in advance 25% of the service order value
- 11 days or more in advance No Charge
9. SUSPENSION OF ONLINE SERVICES
- Sector 6 reserves the right to suspend ongoing services, such as (but not limited to) the online gallery or other distribution of pictures at our discretion, and also reserves the right to inform the reason of this to third parties to whom this suspension of service affects if we deem appropriate
10. IMAGES
- 10.1 Sector 6 will edit every take and deliver what it considers to be the best of every situation covered. As a result, contact sheets (or their digital equivalent) will only be supplied to the client in exceptional circumstances.
- 10.2 No addition to, deletion from or alteration to or adaptation of a picture may be made without the written permission of Sector 6
- 10.3 Unless a rejection fee has been agreed in advance, there is no right to reject on the basis of style, composition or editing.
11. LAW AND JURISDICTION
- Contracts for the purchase of Products through our site will be governed by English law. Any dispute arising from, or related to, such Contracts shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.
12. OUR RIGHT TO VARY THESE TERMS AND CONDITIONS
- We have the right to revise and amend these terms and conditions from time to time (without prior notice) to reflect changes in market conditions affecting our business, changes in technology, changes in payment methods, changes in relevant laws and regulatory requirements and changes in our system's capabilities
